VOLUNTEER TERMS & CONDITIONS

The Company: Splendour in the Grass Pty Ltd. (hereafter may also be referred to as “SITG”, “the Festival”, “the Company” or “we”)

These Terms & Conditions set out the relationship between a volunteer and Splendour in the Grass.

This is not an employment agreement and is not intended to create any employment relationship (i.e you are not an employee of Splendour in the Grass Pty Ltd).

EVENT ADDRESS

Splendour in the Grass is located at North Byron Parklands, 126 Tweed Valley Way, Yelgun NSW 2483

EVENT VOLUNTEER

You may be required to assist in a variety of areas and in a variety of capacities to meet the reasonable demands during the Festival.

All Event Volunteers are expected to volunteer between 18-22 hours (as advised and directed by Promoter).

You will receive:
a) Free access to the Festival.
b) Access to the Festival camping area and facilities in accordance with your level of accreditation. All car parking is offsite for Event Volunteers.
c) 1x volunteer t-shirt.
d) Provision of water and sunscreen when completing volunteer hours.

PREFEST VOLUNTEER

You may be required to assist in a variety of areas and in a variety of capacities to meet the reasonable demands during the Festival.

All Prefest Volunteers are expected to volunteer for two full days from 7.30 am until 5 pm (as advised and directed by Promoter).

a) Free access to the Festival.

CONTACT PERSON

Area Manager: You are expected to follow the reasonable directions of any member of the Festival Management Team.

SHIFT SIGN-ON & OFF

Volunteers MUST sign in and out of your rostered shifts each day.
During PreFest you can sign-on and off with the Volunteer Coordinator, they will be located opposite the OH&S Shed in the Parking area. During the festival Event Volunteers should sign-in and out at HQ with a Volunteer Team Leader.

POLICIES AND PROCEDURES

In addition to the terms and conditions set out herein, you are required to comply with all other policies and procedures of the Festival made known to you, including without limitation, the terms and conditions of entry on the Festival event and camping ticket.

PHOTO IDENTIFICATION

All Volunteers will be required to provide current and valid photo ID as part of their application process.

HEALTH & SAFETY INDUCTION

Splendour in the Grass is serious about your safety and you must read and understand the OH&S policies and follow instructions of accredited staff for your own safety. Splendour in the Grass cannot be held responsible for any damage to your property or injury to yourself during the course of your contract. In consideration of being granted entry to the festival, you agree to indemnify and hold harmless Splendour in the Grass, its employees, contractors and sub-contractors from any costs, damage, liability, injury or death howsoever caused during the course of your contract, regardless of the negligence of Splendour in the Grass, its contractors, sub-contractors, guests or festival patrons.

All contractors are required to complete OH&S induction prior to commencing provision of services on site. This induction MUST be completed before you arrive at the Festival.

You must comply with all Promoter and Splendour in the Grass policies and procedures that are made known to you. At all times on site you are a representative of the Promoter and Splendour in the Grass, and your behaviour with regards to health, safety and security needs to reflect a professional working environment. You have been engaged to perform a professional task and as such should act accordingly.

STANDARDS OF BEHAVIOUR

You must behave in a responsible, honest, friendly and helpful manner at all times. The Festival will not tolerate: discrimination or harassment of patrons or Festival personnel; rude, threatening or antisocial behaviour; wilful disobedience; serious misconduct; fraud; attempted fraud; theft; attempted theft; dishonesty; wilful or reckless damage to the Festival’s property; wilful or reckless injury to another person; wilful or negligent disclosure or misuse of Confidential Information; illegal activity. You must not be under the influence of alcohol &/or illegal drugs while providing volunteer services.

REMOVAL/CESSATION OF SERVICES

If you breach any terms and conditions or engage in gross misconduct, the Festival/Promoter may remove you from your position without notice, and you will be immediately removed from the Festival site. On being removed, however occurring, you shall immediately deliver to the Festival/Promoter all property belonging to the Festival/Promoter, which is in your possession or under your control.

CONFIDENTIALITY

You must use the Confidential Information only in the proper performance of your duties and Participation with the Festival.

“Confidential Information”: Means all information provided by the Festival to a Participant; all information which a Participant becomes aware of which concerns the business and affairs of the Festival, the Promoter or a Participant. Confidential Information includes Intellectual Property.

“Intellectual Property”: Means an invention or discovery; manner, method or process; drawing or design; computer program; copyright, including written works and photographs; trade secret, know-how, or right of secrecy or confidentiality in respect of any information or document.

“Participant”: Means a volunteer or worker at the Festival.

“Participation”: Means volunteer or worker duties and attendance at the Festival as a guest or in any other capacity. Participation may include Participation before, during or after the Festival.

“Confidentiality”: This agreement applies during your Participation or at any other time thereafter.

All files, letters, memorandums, reports, records, documents, data and other tangible material, on computer systems, paper files or otherwise, containing Confidential Information which you prepared, or which may have come into your possession are the property of the Promoter and the Festival.

You must keep the Confidential Information secret and confidential, and must not disclose, communicate, or otherwise make known to any person, company or organisation, any part of the Confidential Information without the prior written consent of the Festival. You must carefully store and dispose of any Confidential Information to ensure it remains confidential.

If you learn or believe that:
a) any un-authorised person has come into possession of any part of the Confidential Information;
b) any person has made any improper or un-authorised use of the Confidential Information; or
c) any person is doing anything in contravention of the Festival’s rights concerning the Confidential Information
you must immediately notify your Area Manager contact from the Festival.

You must not copy or remove from the possession of the Festival any Confidential Information without the prior written consent of the Festival.

Whenever requested or upon cessation of your Participation, you must promptly deliver to the Festival all property of the Festival, including but without limitation, any Confidential Information, documents, keys, equipment, accreditation, records which may have been prepared by you or which may have come into your possession in the course of your Participation and you will not retain copies or notes and extracts of

PUBLIC RELATIONS

You must not give media or other interviews, on or off the record, without obtaining authority from the Festival Promoters.

You must endeavour to protect the public image of the Festival at all times. You must not record, discuss, disclose or circulate in any way any information, stories, incidents, images etc that you become aware of that may, in the opinion of Festival Promoters, harm the public image of the event in any way.
You must respect the privacy and public image of all Participants, and must not photograph, film or record in any way any person who is not in a fit / unaffected state or anything which may be reasonably regarded to be offensive or inappropriate for general public viewing.

PHOTOGRAPHY, VIDEO AND SOUND RECORDINGS

You agree that any images, video and sound recordings taken of you while volunteering or working may be used by the Festival as positive promotion of the Festival.

SECURITY – CHECKS

Depending on the place or nature of your volunteer position, you may be required to undergo a security check on behalf of the Festival. All staff and volunteer bags will be checked upon entry to the site.

AUTHORITY TO ACT:

You agree that you will not undertake any activity outside the specific terms of your engagement as an Event Volunteer and agree that you have no authority to bind the Festival or Promoter to any contract or obligation, and will not directly or indirectly assume or create any obligation on behalf of the Festival or Promoter.

MEDICAL HISTORY

You warrant that you do not have any medical history, pre-existing illness or injuries, which could be aggravated by the type of work you have been allocated.

Attending the Festival is at your own risk. Without limiting the generality of this, appropriate footwear and clothing must be worn at all times at the Event and earplugs should be worn if necessary. The Festival takes no responsibility for any hearing damage or loss caused by excessive noise or injury caused by your failure to follow the Festival’s directives. In the event of injury or illness, the Festival may, at your cost, arrange medical treatment and/or emergency evacuation as deemed essential for your safety.

DEPOSIT

Accepted Volunteers MUST register a valid credit card prior to their arrival on-site. The Credit Card will not be charged at that time. A Pre-Authorisation will be held on your card and your card will only be charged if you do not complete your shifts as agreed.

Event Volunteers will be working over the 5 days of the Festival this is the only way we can ensure all volunteers complete their rostered shifts and do not abandon their duties. Any Event Volunteer who fails to attend or complete their agreed shifts will have the value of a full event ticket ($415.00) + camping ($135.00) and an additional $100.00 administration fee charged to the credit card details provided.

Unless otherwise agreed by Promoter, any Event or Prefest Volunteer who fails to provide at least 48 hours’ notice (from their scheduled arrival date) of cancelling their position or is found in breach of their Volunteer Terms and Conditions will be charged a $100 administration fee within the discretion of the Festival Management. The best way to avoid this charge is to keep Festival Management informed.

ACKNOWLEDGEMENT AND CONFIRMATION

By agreeing to provide volunteer services for the Festival, you acknowledge that you have read, understood and accept all of the terms and conditions contained herein.

WORKER / CONTRACTOR TERMS & CONDITIONS

This is not an employment agreement and is not intended to create an employment relationship (i.e you are not an employee of Splendour in the Grass Pty Ltd).

YOUR ROLE AS A CONTRACTOR

If you are successful in your application, you will be appointed a paid contractor position at the Festival.

You will be engaged by a third-party contractor management company as a contractor. Contractor roles vary, you can select your preference during the application process. We cannot guarantee your choice of role.

You will be rostered according to your role and shifts times cannot be changed. Shifts are confirmed prior to you arriving onsite.

WHAT YOU CAN EXPECT FROM SPLENDOUR IN THE GRASS

• Onsite training briefings prior to commencement of your first shift.

6 am and 3 am during the event.

PAYMENT

As an independent contractor, you have no entitlements to any benefits, payment or allowances including annual leave, personal leave, long service leave or any other leave.

Payments are processed within 30 days of the end of the event.

To ensure accurate payment and timesheet records you MUST sign-on and off at HQ before and after each shift.

ACCREDITATION & PASSES

While working on site at Splendour in the Grass you will be issued with a Working accreditation pass or wristband that you must display to festival security staff when asked. Lost passes and wristbands will not be replaced.
